Terms, Conditions and Consent

Welcome to LyfeMedix (the “Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile applications, telemedicine platform, services, and products (collectively, the “Services”). Please read these Terms carefully. By accessing, registering for, using, or purchasing any Services from LyfeMedix, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use the Services.

 

1. Definitions

  • “User”, “you”, “your” means any individual or entity using the Services.

  • “Content” means text, images, audio, video, documentation, data, reports, recommendations, plans, and other materials provided by LyfeMedix.

  • “Telemedicine/Telehealth” refers to remote clinical services provided through digital communications (audio, video, text).

  • “Third-party Services” refers to services provided by vendors, partners, or other entities that we may recommend or link to.

 

2. Eligibility

You must be at least 18 years old (or the legal age for medical consent in your jurisdiction) to use our Services. By using the Services, you represent and warrant that you meet the eligibility requirements and that any information you provide is accurate and complete.

 

3. Account Registration & Security

a. To use certain Services you may need to register and create an account. You agree to: (i) provide accurate, current and complete information; (ii) maintain and promptly update your account information; (iii) keep your password and account credentials confidential; and (iv) accept responsibility for all activities that occur under your account.

b. Notify us immediately of any unauthorized use of your account or any other breach of security.

 

4. Services, Bookings & Payments

a. Bookings & Confirmation. Seminar bookings, consultations, plans, packages, or other paid Services are confirmed only after we receive full payment (or a non-refundable deposit where applicable) and an order/booking confirmation is issued.

b. Fees & Taxes. All charges are as quoted on our site or as agreed in writing. You are responsible for applicable taxes and payment processing fees unless otherwise specified.

c. Payment Methods. We accept payments via the payment methods displayed during checkout. We may use third-party payment processors; using such processors is subject to their terms.

d. No Cancellation & Refunds. Due to the personalized nature of healthcare services, wellness plans and telemedicine consultations are non-cancellable and non-refundable once purchased. Our clinical team invests time and professional expertise in reviewing reports, preparing treatment plans, and allocating resources once a plan is activated. Valid exceptions (e.g., duplicate payments due to technical error, or LyfeMedix’s failure to deliver an agreed service) will be considered on a case-by-case basis in accordance with our No Cancellation & Refund Policy.

 

5. Telemedicine / Telehealth Consent & Disclosures

a. By booking and paying for telemedicine services, you give voluntary and informed consent to receive medical consultation via digital communication (audio, video, and/or text) in accordance with applicable medical ethics and data privacy standards. See our Telehealth Consent and Patient Consent provisions for additional information.

b. You acknowledge the benefits and limitations of telemedicine (including diagnostic limitations and potential data risks). Telehealth is not a substitute for emergency care. If you have an emergency, you must contact local emergency services immediately.

c. You agree to provide accurate and complete medical information and to follow reasonable instructions given during teleconsultations. Providers may, at their discretion, recommend an in-person consultation if clinically necessary.

 

6. Privacy & Data Protection

We process personal and health data in accordance with our Privacy Policy (available on our website). By using the Services, you consent to such processing for treatment, administrative, and quality improvement purposes. We do not sell personal health data. 7. Intellectual Property

a. All Content, trademarks, logos, designs, software, and materials on the Services are the property of LyfeMedix or its licensors and are protected by applicable intellectual property laws.

b. You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use, subject to these Terms.

c. You retain ownership of your personal data and any original content you submit; however, by submitting data, reports, or feedback you grant LyfeMedix a worldwide, royalty-free, perpetual, non-exclusive right to use such information for treatment, quality improvement, training, anonymized research, and service enhancement unless otherwise agreed in writing.

 

8. User Conduct & Obligations

You agree not to: (i) use the Services for unlawful or unauthorized purposes; (ii) impersonate others; (iii) transmit harmful or illegal content; (iv) interfere with the Services or systems; or (v) circumvent security features.

You must comply with any clinical instructions and provide accurate medical histories and relevant information necessary for appropriate care.

 

9. Third-Party Services and Recommendations

We may list or recommend Third-party Services (partners, vendors, apps, products). These are optional and curated for your convenience; use of such services is at your sole discretion. LyfeMedix is not responsible for third-party content, quality, security, or privacy practices. Any transaction or relationship you enter into with a third party is solely between you and that third party.

 

10. Disclaimers & Limitation of Liability

a. Medical Disclaimer. The Services, Content, and recommendations are for informational and treatment purposes only and do not constitute emergency care. Telemedicine has inherent limitations; providers may advise in-person care if necessary.

b. No Warranty. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYFEMEDIX PROVIDES THE SERVICES “AS IS” AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

c. Limitation of Liability. EXCEPT TO THE EXTENT PROHIBITED BY LAW, OUR LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES IS LIMITED TO THE AMOUNT YOU HAVE PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRIOR TO THE EVENT. IN NO EVENT SHALL LYFEMEDIX BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.

d. Nothing in these Terms limits liability for death or personal injury resulting from our negligence, or for any liability that cannot be excluded by applicable law.

 

11. Indemnity

You agree to indemnify, defend, and hold LyfeMedix, its officers, directors, employees, agents, and affiliates harmless from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of law.

 

12. Termination & Suspension

We may suspend or terminate your access to the Services without notice if you violate these Terms, for security reasons, or for other legitimate business reasons. Termination does not relieve you of obligations (e.g., payment) incurred prior to termination. Provisions that by their nature should survive termination (e.g., IP, indemnity, disclaimers, governing law) shall survive.

 

13. Refunds & Dispute Escalation

a. Refund requests are governed by our No Cancellation & Refund Policy. Valid exceptions (duplicate payments, failure to deliver service by LyfeMedix) will be considered and investigated.

b. If you have a complaint or dispute, please contact our support team first at the contact details below. We will attempt to resolve issues promptly and in good faith.

 

14. Force Majeure

We are not liable for failure or delay in performing obligations caused by events beyond our reasonable control (e.g., natural disasters, strikes, pandemics, internet outages). We will use reasonable efforts to resume performance when possible.

 

15. Notices

We may provide notices by posting on the Services, emailing the account email, or by other reasonable means. You consent to receive electronic communications from us. For legal notices, use the contact address below.

 

16. Changes to Terms

We may modify these Terms from time to time. Material changes will be posted on our website with an updated effective date and, where appropriate, notified to you. Continued use of the Services after changes constitutes acceptance of the revised Terms.

 

17. Governing Law, Dispute Resolution & Jurisdiction

a. Governing Law. These Terms are governed by and construed in accordance with the laws of India.

b. Dispute Resolution. In the event of any dispute, claim or controversy arising out of or relating to these Terms or the Services, the parties shall first attempt to resolve the dispute amicably through good-faith negotiations.

c. Arbitration / Courts. Any dispute not resolved by negotiation within thirty (30) days shall be referred to arbitration administered in Jaipur, Rajasthan in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted in English and the seat of arbitration shall be Jaipur, Rajasthan, India. The arbitral award shall be final and binding.

If arbitration is not available or a party seeks urgent injunctive relief, the courts located in Jaipur, Rajasthan shall have exclusive jurisdiction over any disputes and each party submits to the exclusive jurisdiction of such courts.

Note: You expressly agree that all disputes, whether in arbitration or in court, shall be subject to the venue of Jaipur, Rajasthan and governed by Indian law.

 

18. Severability & Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective. Failure or delay by LyfeMedix to exercise any right shall not be a waiver of that right.

 

19. Miscellaneous

a. Assignment. LyfeMedix may assign or transfer its rights and obligations under these Terms to an affiliate or successor; you may not assign these Terms without our prior written consent.

b. Entire Agreement. These Terms, together with any referenced policies (Privacy Policy, No Cancellation & Refund Policy, Accessibility Statement), constitute the entire agreement between you and LyfeMedix regarding the Services.

c. Language. These Terms are in English. If there is any conflict between translations (if any) and the English version, the English version shall prevail.
